Water quality data will be provided as approved in the current monitoring plan for the <br />site. Once <br />Both the DRMS has collected adequate data; some of these wells will be designated as <br />compliance <br />Wells. <br />CC&V RESPONSE: CC&V has agreed to conducting surface water monitoring <br />pursuant to the current monitoring plan at the referenced locations. <br />B) CC&V will install two additional GW monitoring points PGMW 3 & 4 in the thalweg of <br />the gulch, <br />in addition to PGMW-2, (which is dry). Each well will be advanced to bed rock <br />CC&V RESPONSE: CC&V has agreed to install the noted additional monitoring <br />sites. <br />3) The change in water balance from static to dynamic will not allow CC&V to operate at any <br />time above the 80% total capacity of all the pregnant ponds for the valley leach facility. <br />CC&V RESPONSE: CC&V asserts that there is no proposed change in the way that <br />the PSSAs are managed as a result of using dynamic water balance modeling. The <br />operating constraint is to notify the Division if any PSSA exceeds the 80% operating <br />level and to propose an immediate plan to lower the PSSA below the 80% operating <br />level. <br />4) CC&V, will provide periodic( once every six months) updates of all areas of the pit high <br />walls that will require special blasting and wall preparation as outlined in Appendix 5, Volume <br />IV. <br />CC&V RESPONSE: CC&V proposes to provide an annual high wall review as part <br />of the Cresson annual report. This review will be prepared by CC&Vs designated <br />geotechnical engineer (P.E.) and the report will discuss any necessary high wall <br />stabilization or provide evidence that the existing high walls are stable. <br />5) The DRMS, recommends long term monitoring of the Carlton Discharge after closure and <br />release of the areas covered by the DRMS permit. The Division is aware that the discharge from <br />the tunnel is under a NPDES discharge permit, regulated by the Colorado Department of Health <br />and Environment. <br />6) CC&V has requested to post the total financial warrantyfor the site in phases, which will be <br />$97,502,035.00, when amendment 9 is approved. However, all the financial warranty for the site <br />will be posted once the Phase V valley leach pad liner is constructed and certified and prior to <br />placement of ore.
