Dear Mr. Keffelew:

Cripple Creek & Victor Gold Mining Company (CC&V) herein provides responses to the final
adequacy comments from the Division of Reclamation, Mining and Safety (DRMS) that are
shown as numbered and italicized items below and were provided by email on October 15, 2008.
The CC&V responses to those final adequacy comments are provided in bolded text that follows
each comment.
1) The revision to completely backfill the North Cresson (Poverty Gulch area) will be submitted
as an Amendment to the permit and not as a Technical Revision as you stated in the response to
our concern.
CC&V RESPONSE: Amendment No. 9 is a stand alone application and is
approvable as submitted. Subsequent changes that CC&V may propose, such as
partial backfilling and regarding of the North Cresson high wall visible to the City
of Cripple Creek is not germane to the approval of Amendment No. 9 as submitted.
CC&V respectfully requests that changes that may be proposed in the future to
partially backfill and regrade the North Cresson high wall can be discussed in the
future. At the time, with submittal of a subsequent revised backfill plan for the
North Cresson highwall area, the DRMScan determine whether to process the
submitted information as a technical revision or an Amendment. That process does
not need to be resolved at this time with respect to Amendment No. 9 approval.
2) Ground and surface water monitoring of the Riparian areas will include:
A) GVMW-04A & 04B, GVMW-08A & 08B, GVMW-10, GVMW-14B & C, GVMW-16B,
GVMW 23A &B
Piezometers, 1, 2, 3 & 4. Surface water monitoring locations at Grassy Valley stations
GV 01 thru 04.
