M. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection of the Yoast Mine conducted on September 24 and September <br /> 25, 2008 by Mike Boulay of the DRMS. Roy Karo of Seneca Coal Company was present during <br /> the entire inspection. Weather conditions were sunny and warm on both days. Ground <br /> conditions throughout the mine site were dry. <br /> Availability of Records <br /> The availability of records was reviewed at the SCC mine office on September 25th. All required <br /> records were complete and on file at the mine site. Please see the attached Availability of <br /> Records Checklist. <br /> Roads <br /> The entire mine site was accessible. Roads were generally well maintained. The county access <br /> road along Sage Creek was accessible to Ponds 012, 013, and 014. SCC indicated that they will <br /> need to blade the access road to Pond 011 in the near future. As shown in the attached <br /> photograph, Haul Road A narrowing has been completed and looks good. The shoulders of Haul <br /> Road A have been topsoiled and seeded. Small rock check dams have been installed at road <br /> drainage run-outs along Haul Road A. <br /> Hydrologic Balance <br /> Sedimentation Ponds 010, 011, 012, 013, and 014 were inspected. Ponds 010 and 012 were <br /> discharging clear water. The remainder of the ponds were retaining water but not discharging. <br /> Pond inlets, discharge structures and embankments at all sediment pond locations were stable <br /> and functional. The stock pond in the Yoast South area was dry. No problems were noted at any <br /> of the pond locations. <br /> Post-mine drainage channels throughout the site were generally well maintained and stable. <br /> There was no running water in any of the post-mine drainages. The repair work at YPM-8 that <br /> was completed earlier this summer was inspected. The water bar across the road and the <br /> drainage run-out below the road are both stable. Vegetation is taking hold in the turf-reinforced <br /> mat drainage(see attached photo). <br /> Good progress has been made at the Dragline Deadhead Route channel reconstruction project. <br /> The channel grading work and the low water crossing have been completed. The low-water <br /> crossing location had to be moved further to the north then planned to allow for obtaining the <br />
