M. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection of the Seneca II-W Mine conducted on September 24, 2008 by <br /> Mike Boulay of the DRMS. Roy Karo of Seneca Coal Company(SCC) was present during the <br /> entire inspection. Weather conditions were sunny and warm. Ground conditions were dry <br /> throughout the mine site. The only activity at the site was a crew planting trees in the Aspen <br /> planting area along the ridgeline area. Cattle were seen grazing above Pond 016A. <br /> Availability of Records <br /> Records were checked on September 25`h at the Seneca Mine office. All required records were <br /> on file and available for review at the mine site office. No problems were noted with the records <br /> review. See the attached Availability of Records checklist. <br /> Roads <br /> With exception of Pond 015 all mine site roads were accessible. Roads A, J, Ridgeline Access <br /> Road and Road G were viewed as part of this inspection. As shown in the attached Photograph <br /> #1, SCC is in the process of spreading additional topsoil and reseeding a small area upslope of <br /> the haul road where vegetation was sparse and some erosion had recently occurred. Road <br /> surfaces and road ditches were in good condition and generally well maintained throughout the <br /> mine site. <br /> Hydrologic Balance <br /> Site Sedimentation Ponds 005, 006, 009, 016, 016A, and 017 were inspected. All of these ponds <br /> were full and discharging clear water. Pond 009 was only discharging a very small amount of <br /> water. Pond 015 could not be inspected because the road up to the pond was blocked by an oil & <br /> gas work over rig. Pond inlets, discharge structures and embankments were stable and <br /> functioning properly at these pond locations. <br /> Post mine Drainage PM-41) on the east side of the mine at Slide Area#1 was inspected. This has <br /> just been completed. As seen in the Photograph#2, a black discharge pipe has been installed <br /> over a turf reinforced mat down the length of the reclaimed slope. The installation looks good <br /> and appears well constructed. Drainage channels that were inspected all appear to be <br /> Post mine drainage channels above the inlet to Pond 016A that had been damaged in a rain event <br /> earlier in the summer have been mostly restored and repaired. SCC had installed new fabric in <br />
