M. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection of the Seneca II Mine conducted on September 25, 2008 by Mike <br /> Boulay of the DRMS. Roy Karo and Scott Belden of Seneca Coal Company/Peabody Energy <br /> were present during the entire inspection. Weather conditions were sunny and warm. Ground <br /> conditions throughout the mine site were dry. There was no activity at the site during this <br /> inspection. Approximately 900 cattle had been grazing the mine site,but were moved off about <br /> two weeks ago. <br /> Availability of Records <br /> The availability of records was reviewed on September 25 and no problems were noted. All <br /> required records were complete and on file at the mine site. Please see the attached DRMS <br /> Availability of Records Checklist. <br /> Roads <br /> Road surfaces throughout the site were dry and generally well maintained. The entire mine site <br /> was accessible. Road ditches and culverts appeared well maintained and functional. <br /> Water bars have been installed along a section of the South Road between Ponds 004 and 008. <br /> These are well constructed and should aid in controlling erosion by dispersing concentrated <br /> flows. <br /> Hydrologic Balance <br /> Ponds 002, 003, 004, and 008 were inspected. All of the site sedimentation ponds were full and <br /> discharging clear water. The Truck Wash settling pond remains at the site. The supply pond has <br /> been reclaimed. The location of the former supply pond has been regraded to approximate <br /> original contour and the area topsoiled and seeded. No problems were noted at any of the pond <br /> locations. <br /> Support Facilities <br /> An old USGS weather station on the reclaimed Pre-Law lands located above Road E1 was being <br /> dismantled and removed by USGS personnel during this inspection. This site was noted during <br /> the SL-2 bond release inspection of the area, and was determined as not posing a problem since <br /> the site was stable with good vegetative cover. According to SCC, the site is no longer needed <br /> and all equipment will be removed and the site properly restored. <br />
