III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Janet Binns of Colorado Division of'Reclamation. Mining <br />and Safety. Mr. Ron Thompson of Peak Project Management (representing the operator) accompanied <br />the inspection. The weather was hot and dry. The mine was a surface mine. New Elk Coal Company is <br />not actively mining coal. The Mine is reclaimed. <br />Roads: Roads within the permit area are in good condition. No large erosional features were noted on <br />the roadways. Recent heavy rains had not resulted in gullying of the roadways. A culvert under the <br />access road at W'-6 is clogged. The operator indicated that (ras operations placed this culvert Without <br />NI:C'C' approval. The culvert needs cleanout to avoid runoff flowing over the road due to the clogged <br />culvert. <br />lydrologic Balance: Due to recent rains all the mine ponds. Pond 9A, Pond 9. Pond 9. Pond 6 and Pond <br />7, were holding water, but none were currentl?, discharging. Water in all ponds was very cloudy. <br />The culvert on the west side of till 9 has sediment deposition due to the recent rain storms and needs <br />sediment clean out ofthe outlet. This culvert may still pass flows but the sediment has reduced the <br />anu0unt of llow this culvert can handle. <br /> <br />L - <br />kip <br />?e• !'£ ? _ ~ `. •r JM - ? 1R 111..E .? <br />Outlet of Fill 9 West culvert <br />There has been concentrated flow and Borne gully lOrmation on the northwest slope of parcel N-1. The <br />gully has cut approximately 18" deep and dissipates at the reclaimed ditch. Runoff from this slope flows <br />to pond 8 so there is no ollsitc impact from this gully.
