III. COMMENTS -COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made during
the inspection. Comments also describe any enforcement actions taken during the inspection and the
facts or evidence supporting the enforcement action.
Reclamation Success: Mr. Patterson showed the inspector a location that EFC is considering for a
proposed reference area revision. The currently approved reference area is located in a heavy pinyon-
juniper community. The approved post-mining land use is rangeland and wildlife habitat. The location
discussed during the inspection for a potential reference area is located along the northeast corner of the
RDA. It is composed on a mix of native grasses and pinyon juniper complex. This location is narrow
and drops off steeply to the east. The potential location exhibits a greater amount of open grassy pockets
within the pinyon juniper that would benefit grazing usage. The operator has not sampled this location
yet for cover,production, woody stem density or diversity values. Nor has the operator submitted a
revision to the permit regarding a change to the reference area. However, the potential reference site
appears healthy, narrow and the limited acreage may limit the ability to comply with rule 4.15.7(3)(c).
