PROPOSED DECISION <br /> EASTSIDE COAL COMPANY <br /> EASTSIDE MINE <br /> The Colorado Mined Land Reclamation Division proposes to approve, with <br /> stipulations, an application for renewal of a permit to conduct coal mining <br /> and reclamation operations submitted by Eastside Coal Company for the Eastside <br /> Mine. <br /> This approval decision is based on a finding that the proposed operation will <br /> comply with all requirements of the Colorado Surface Coal Mining Reclamation <br /> Act, C.R.S. 1973, as amended, 34-33-101 et seq. , and the regulations <br /> promulgated pursuant to the Act. <br /> The permit application and the stipulations will become a binding part of the <br /> permit upon approval . Two stipulations for the Eastside Mine have been <br /> continued and modified from the original permit approval, and are as follows. <br /> STIPULATION NO. 1 <br /> THE PERMITTEE WILL PERFORM THE MONITORING OUTLINED BELOW AND SUBMIT A <br /> HYDROLOGIC MONITORING REPORT ANNUALLY IN JANUARY TO THE DIVISION <br /> INCORPORATING THE FOLLOWING MONITORING DATA. <br /> SURFACE WATER <br /> 1 . MONTHLY MONITORING OF THE HARVEY GAP RESERVOIR OUTLET AND THE SAMPLE <br /> SITE DESIGNATED AS HARVEY GAP BELOW THE MINE (ON MAP HGP-18). THIS <br /> MONTHLY MONITORING MUST INCLUDE FLOW AND FIELD PARAMETERS. SEMI-ANNUAL 'J <br /> SAMPLES ARE TO BE TAKEN- FOR THE FULL SUITE CHEMICAL PARAMETERS AS <br /> DESIGNATED LATER IN THIS SECTION. ' <br /> 2. SEMI-ANNUAL MONITORING OF THE HARVEY-GAP RESERVOIR SEEP INCLUDING <br /> FLOW AND FIELD PARAMETERS. <br /> 3. COMPILATION OF ALL DATA SUBMITTED TO THE COLORADO DEPARTMENT OF <br /> HEALTH FOR COMPLIANCE WITH THE NPDES PERMIT SAMPLING REOUIREMENTS, <br /> INCLUDING SALINITY. <br /> GROUND WATER <br /> 1 . CONTINUATION OF AN INFLOW STUDY AT THE MINE WITH THE SOURCES OF SEEPS <br /> MAPPED ONCE YEARLY. FLOWS AND FIELD PARAMETERS SHALL BE SAMPLED AS <br /> PRACTICABLE. A HEAVY INFLOW MONTH SUCH AS JULY WILL BE CHOSEN FOR INFLOW <br /> MAPPING. ANY NEWLY DEVELOPED SOURCES OF INFLOW THAT HAVE FLOW OF 0.5 GPM <br /> OR GREATER WILL BE TESTED ONE-TIME FOR THE FULL SUITE OF CHEMICAL <br /> PARAMETERS. <br /> -2- <br /> O <br />
