Dear Ms. Shultz:
The Division of Reclamation, Mining and Safety (DRMS) has completed its adequacy review of
Technical Revision (TR03). The revision was received on September 17, 2008 and called
complete for review on September 18, 2008. The decision date for TR03 is October 18, 2008.
Please be advised that if you are unable to satisfactorily address any concerns identified in this
review before the decision date, it will be your responsibility to request an extension of the
review period. If there are outstanding issues that have not been adequately addressed prior to the
end of the review period, and no extension has been requested, the Division will deny this
revision.
This revision (TR03) was submitted concurrently with a request for a partial bond release for the
20% bond option for the slurry wall around the Golden phase area. This wall has been recently
approved by the State Engineer's Office. Because this is just a partial release request associated
only with the 20% bond option for the Golden phase slurry wall and not a total acreage release,
and the fact that additional bonding will be required for the next three phases addressed in TR03,
the Division will consider both of these issues as part of TR03 and not separately so that only one
bond adjustment will be required.
The Division has only minor comments that require addressing at this time on TR03. Because no
new technical specifications were submitted with TR03 for the slurry walls to be constructed
around the Parker-Panowicz, Swingle North, and Swingle South areas, please commit that
specifications and practices will be used for these new walls that are at least equivalent to those
used for the Golden phase slurry wall for which plans were already submitted. This will allow
the Division to use the 20% bond option for the three new slurry walls.
Because the original bond for this site is from year 2000 with only the adjustments made for
slurry walls, additional bonding will be required for the next three phases of operation, and the
total affected acreage has increased substantially, the Division will need to recalculate the total
bond amount for the site. In order for the Division to accurately calculate reclamation costs,
