III. COMMENTS - COMPLIANCE <br /> Colowyo C-1981-019 <br /> 9 September 2008 <br /> Pg 1/4 <br /> Below are comments on the inspection. The comments include discussion of observations <br /> made during the inspection. Comments also describe any enforcement actions taken during <br /> the inspection and the facts or evidence supporting the enforcement action. <br /> This was a complete inspection of the Colowyo Mine conducted by Jim Stark of <br /> CDRMS. The inspection was conducted on 9, 10 and 1 1 September 2008. Tay Tonozzi <br /> of CCC accompanied me on 9 September 2008 and Ryan Pawlowski of CCC <br /> accompanied me on 10 and 11 September 2008. The mine was actively mining coal <br /> and hauling coal to the loadout at the time of the inspection. The weather warm <br /> and overcast on 9 September 2008, it was cool and rained on 10 September 2008 <br /> (and it rained hard at times) and it was cool and overcast on 1 1 September 2008. <br /> Signs and Markers: - All of the necessary signs were in place as required at the time <br /> of the inspection. Mine ID signs were in place at the main entrance and at all of the <br /> ponds along Colorado Highway 13 as required. Colowyo has a mine identification <br /> sign at the access point along Colorado Highway 13, which is the access point to the <br /> Section 28 Pond. <br /> Roads: - The mine access road and haul road to the Gossard Loadout is a paved <br /> road. The road was well maintained and in good condition. <br /> - The haul roads in the East and West pit areas appeared to be well maintained and <br /> stable at the time of the inspection. No erosional problems were noted on these <br /> roads. There was some dust on the roads on 9 September 2008 (before the rains) but <br /> the operator was actively watering the roads. <br /> - The light-use roads around the Gossard Loadout and to the rail loop were dry and <br /> appeared to be well maintained and in good condition at the time of the inspection <br /> - The light-use roads in the East Pit reclamation area were all dry. There was some <br /> minor rutting and rilling but overall these roads appeared to be stable and were in <br /> good condition. <br /> - The road in Taylor draw (to the West Pit and East Ponds) was recently bladed up to <br /> the East Taylor Pond. There we some mud and water in a few of the low spots but <br /> overall the road was dry. The road appeared to be stable and was in overall good <br /> condition. No erosional problems were noted on the road. <br /> - The Sturgeon road work has been completed. This includes the blading, <br /> establishing the Missouri crossings and placing a gravel surface on the road. The <br /> road has been completed and surfaced to the Section 28 Pond. The road was <br /> somewhat wet from the rains the day before but appears to have held up well. The <br /> road was well maintained and appeared to be stable at the time of the inspection. <br /> No erosional problems were noted on the road at the time of the inspection. <br />
