6.3.3 EXHIBIT C - Mining Plan <br />The Mining Plan indicates that "approximately 2 feet of topsoil or overburden will be <br />replaced into its original location". Please clarify if this material is topsoil or overburden. <br />The Division defines overburden as all of the earth and other materials which lie above <br />natural construction materials and also means such earth and other materials disturbed <br />from their natural state in the process of mining. Topsoil is defined as the material at the <br />surface of the earth which has been so modified and acted upon by physical, chemical, <br />and biological agents that it will support rooted plants necessary to achieve reclamation <br />goals. Please specify how the topsoil stockpiles will be stabilized to prevent erosion as <br />required by Rule 6.3.3(b). In addition, please specify the dimensions of the area where <br />the stockpiles will be stored, as well as the dimensions of the stockpile(s). <br />The Mining Plan indicates that a protective bank will be left on the side of the draw. <br />Please specify if this protective bank will be created by the operator or if it will simply be <br />existing material that is left in place. Also, specify the dimensions of the protective bank. <br />The Applicant should note that the protective bank should be one foot above flood <br />elevation levels. In addition, the Division requests that the applicant provide the flood <br />elevation(s) of Surveyor Creek to be expected during a ten year, 24 hour storm event. <br />6.3.4 EXHIBIT D - Reclamation Plan <br />The Reclamation Plan states that "overburden will be replaced to the approximately two <br />to five foot depth which is presently in place". Please clarify if this material is overburden <br />or topsoil; see the comments under Exhibit C regarding the difference between topsoil <br />and overburden. The Reclamation Plan states that "whatever the topsoil depth is will be <br />replaced at roughly the same depth as presently exists". Please commit to replacing <br />topsoil to a depth of 16" -24" or specify the anticipated minimum depth or range of depth <br />for the reclaimed areas of the site. The Reclamation Plan states that "Once the topsoil is <br />spread ...it can be drilled with little or no further tillage...". Please indicate how the <br />seedbed will be prepared to eliminate compacted conditions (e.g., plowed, chiseled, <br />disced). The reclamation cost estimate provided by the applicant indicates that fertilizer <br />will be applied. If fertilizer is to be used, please specify the type, application rate, and soil <br />incorporation methods as required by Rule 6.3.4(l)(c)(ii). The applicant should note that <br />soil amendments shall only be applied where soil tests indicate nutrient deficiencies for <br />the plant species to be established. Also, please provide the Division with a weed control <br />plan for noxious weeds. There may not be any noxious weeds present at the site, but <br />having a weed control plan up front will help to prevent infestation of noxious weeds. <br />The Applicant has indicated that the maximum gradient of the reclaimed slopes will be <br />no greater than 3:1, please specify what the actual maximum gradient will be. The <br />Division requests that the Annlicant snecifv the noint during the oneration when the site <br />has reached a point of maximum disturbance. Also, from this point include the haul or <br />push distances related to backfilling and grading. The Division is required to complete a <br />separate bond estimate and it is from this point of maximum disturbance that the cost of
