However, the operator chose not to amend the Appendix N <br />tables as suggested. <br />56. Item Resolved. <br />57. DRMS: The operator was requested to add a discussion of the pond <br />drainage and sediment pond discharge to the PHC analysis in Appendix N. <br />Given the close proximity of the proposed pond to East Salt Creek, the operator <br />was also asked to include an assessment of the need for installation of a <br />protective clay liner in the pond, and include such design modification as <br />appropriate. The operator modified Appendix N to include a discussion of the <br />existing sediment pond with regard to infrequent discharge and low conductivity, <br />and concluded that the impact of the sediment pond is disregarded. <br />Further PHC analysis and modifications to Appendix N may be required, pending <br />resolution of Item #52 (see above) regarding DOW's comment letter concerning <br />the quality of water discharged from the pond, potential for leaching <br />contaminates into the ground water, and the potential need for a pond liner. <br />58. DRMS: The Division noted that the proposed sediment pond will be located <br />within 100feet of a stream with a drainage area of greater than I square mile <br />(East Salt Creek). As such, the provisions of Rule 4.05.18 (Stream Buffer Zones) <br />apply. Operator was requested to, provide narrative addressing compliance with <br />4.05.18(a) and (b) and to delineate the East Salt Creek buffer zone on Figure <br />2.2-3. <br />Item Resolved. The operator provided appropriate narrative in the final <br />paragraph on page 2-42, and properly delineated the stream buffer zone on <br />Figure 2.2-3. Our interpretation of the commitment is that the silt fence between <br />the sediment pond location and the creek (depicted on Figure 2.2-3), will be <br />installed prior to sediment pond construction and maintained until the sediment <br />pond disturbance area is stabilized by an effective interim vegetation cover. <br />Rule 2.06.8 Alluvial Valley Floors <br />59. DRMS: The Division made several requests pertaining to updated alluvial <br />valley floor boundary information pertinent to proposed TR-16 operations. All of <br />the Items originally labeled as 59a) through 59e) have been resolved with <br />exception of Item 59c), as set forth below:
