Cattany <br />RE: Bowie No. 2 Mine, Permit No. C-96-083, Bowie Resources LLC Division Director <br />Technical Revision No. 53, Dewatering Well, Second Adequacy Review Natural Resource Trustee <br />Dear Mr. Bear: <br />The Colorado Division of Reclamation, Mining and Safety (Division) has finished its adequacy review of <br />Bowie Resources LLC's (BRL) responses dated August 11, 2008 and September 18, 2008 to the Division's <br />adequacy review letter dated March 20, 2008 for Technical Revision No. 53 (TR-53). <br />In the August 11, 2008 submittal, BRL changed the proposed plan so that mine water would not be discharged <br />into Hubbard Creek but, rather, would be pumped from the D-seam workings to the surface and, then, piped to <br />the Hubbard Creek ventilation shaft and down into the B seam workings. In the letter dated September 18, <br />2008, BRL has requested that only the drilling of the dewatering well and the construction of the pipeline be <br />approved in TR-53. The actual diversion of water from the D-seam to the B-seam and the discharge of that B- <br />seam water to the North Fork of the Gunnison River would be handled in TR-54. The following are the <br />Division's questions and comments: <br />Section 2.03.6, Right of Entry and Operation Information <br />Please provide the appropriate documentation that demonstrates that the USDA-Forest Service <br />approves of this project. <br />The Division has no further concerns. The USDA-Forest Service provided a copy of their <br />concurrence letter with attachment A to the Division in a submittal dated July 28, 2008. In that <br />same submittal, the USDA-Forest Service requested that the Division acknowledge in its decision <br />and public notice that the protections for non-mineral resources brought forward by the GMUG as <br />the land management agency are a part of the Division's proposed decision for TR-53. <br />Section 2.04.4, Cultural and Historic Resource Information <br />The Division understands that BRL is working with the USDA-Forest Service to determine if <br />cultural resource site 5DT1326 might be impacted by the activities proposed in TR-53. Please <br />inform the Division in writing as to the results of this determination. <br />The Division has no further concerns. In the submittal dated August 11, 2008, BRL revised the <br />proposed road location so that the cultural resources site is avoided. Map 9 was revised to show <br />the new proposed road location.
