III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during <br /> the inspection. Comments also describe any enforcement actions taken during the inspection and the <br /> facts or evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Tom Kaldenbach of the Colorado Division of Reclamation, <br /> Mining and Safety. Jim Jarvis represented the operator. With the operator's consent,this report was issued <br /> from the Denver office of DRMS. <br /> The operator's representative reported that the King I Mine was actively mining in Section 6 and the <br /> King II Mine was mining approximately 8,000 feet in from the portals. The weather was clear and the <br /> ground was dry. <br /> Availabilitv of Records <br /> The results of the records check are shown on the attached list. All required records were available, <br /> including the refuse pile and pond reports for the 4th calendar quarter 2007 (consultant Don May's <br /> report for 4th quarter 2007)that could not be found during the last complete inspection in June 2008. <br /> Signs and Markers <br /> King I-Mine i.d. signs and affected area markers were properly displayed. <br /> King II—A mine i.d. sign was on display at the mine's entrance on County Road 120. The perimeter <br /> of the affected area was marked with"permit boundary" signs and survey stakes. <br /> Roads <br /> King I - The mine entrance haul road was well maintained. <br /> King II -The haul/access road was well maintained. <br /> Hydrologic Balance <br /> King I Ponds - The bottom of the east pond was wet and soft. The west pond contained a small pool <br /> of water. Sediment has recently been removed from both ponds. The sediment removal operations <br /> buried the outlet end of the secondary spillway (8"pipe)of the west pond where it is supposed to <br /> daylight at the base of the pond embankment. The operator's representative explained the pipe outlet <br /> would be uncovered immediately after the inspection. The operator's representative explained that <br /> sediment level markers will be reinstalled as soon as the ponds are dry enough to access. <br /> Embankments, inslopes, and spillways (with the exception of the mentioned 8"pipe) appeared in good <br /> condition. <br /> King II Pond—The pond contained a pool of water approximately 2 feet deep. A catwalk that is to <br /> extend from the pond inslope to the spillway riser culverts should be completed so that PE-certified as- <br /> built design drawings and calculations can be submitted(detail A of design drawing King II-007C <br /> shows the catwalk). The pond embankment, inslopes, and spillway appeared in good condition. <br />
