Anthony Waldron <br />Division of Minerals and Geology <br />1313 Sherman St., Room 215 <br />Denver, Colorado 80203 <br />J/ <br />RE: Request for Technical Revision to increase bonded area of M-1999-120, Fort <br />Lupton Sand and Gravel Mine <br />Dear Mr. Waldron: <br />We respectfully request a Technical Revision JR), to increase our financial warranty (bond) for <br />permitted, but not yet bonded, areas. We have included the $216.00 filing fee. (As a reference, <br />on February 11, 2005, the Division of Minerals and Geology approved the Amendment to our <br />original Fort Lupton Sand and Gravel Mine permit, which added 212 acres to the permit area. In <br />the approval letter, it was specified that L. G. Everist, Inc., would submit a Technical Revision <br />prior to mining in each new phase so that bonding could be calculated and added for the phase, <br />rather than having to bond for the entire site at that time.) <br />We are submitting this Technical Revision to bond for mining and reclamation in the remaining <br />un-bonded permitted areas. The areas to be bonded are: Parker-Panowicz, Swingle-North, and <br />Swingle-South. In these three areas, we will be constructing slurry walls prior to mining, mine <br />them out, and reclaim them as water storage reservoirs, as per the mining and reclamation <br />plans in our amendment paperwork. The areas are explained in more detail below and are <br />highlighted on the attached Mining Plan map. <br />We respectfully request the Division approves a bond to cover 20% of the slurry wall cost, as <br />was done for the slurry wall construction bonded in TR-1. <br />Parker Panowicz area <br />The land area which will be the Parker-Panowicz Pit is located in the north-central section of the <br />permitted area. The slurry wall will be constructed along the boundaries as shown on the <br />attached mining plan map. As is shown in the Mining Phases table on the map, the acreage to <br />be mined is 26 acres, the perimeter length is 4,421 feet, and the average depth to shale <br />bedrock is estimated at 26 feet. The estimated total area of the slurry wall is 114,946 square- <br />feet.
