One perennial forb should <br />comprise 5% of total live vegetative cover excluding annual weeds. <br />For oak/pinion areas, success will be demonstrated for cover and production <br />when the reclaimed area is at least 90 % of the reference area and meets the <br />90% confidence interval using a one-sided T-test. The woody stem density <br />standard is 500 stems per acre. Species diversity standards are 2 cool <br />season grasses and 1 warm season grass comprising 5 to 30 percent of total <br />live vegetative cover excluding annual weeds. One perennial forb should <br />comprise 5% of total live vegetative cover excluding annual weeds. <br />E. The Division approves of the reference areas that the applicant has selected <br />based on the requirements of Rule 4.15.7(3). Extended reference areas will <br />be used. Reduction in size of the permit area from 17,000 acres to 3142 <br />acres as a result of PR-01 will not affect the ability of the applicant to utilize <br />the extended reference area concept. The areas are depicted on Map <br />2.04.10-1 Vegetation Community Map. <br />F. The reference areas will be utilized to determine revegetation success in a <br />manner that the Division finds acceptable (4.15.7(4)). <br />X11. Post-mining Land Use <br />No specific approvals are granted under this section. <br />XIII. Protection of Fish, Wildlife and Related Environmental Values <br />A. Fish and wildlife habitat is secondary use of the reclaimed area. The <br />applicant has a plan for the re-establishment of shrubs on portions of the <br />reclaimed areas of the surface mine. (4.18(5)(1)) <br />XIV. Protection of Underground Mining <br />A. The Division does not approve surface coal mining activities being conducted <br />within 500 feet of an active or abandoned underground mine. (4.19(1) and <br />4.22.4(1)) <br />XV. Subsidence Control <br />No specific approvals are granted under this section. <br />XVI. Concurrent Surface and Underground Mining <br />No specific approvals have been granted under this section (4.22.2). <br />21
