compatible with the post-mining land use, and will meet all the requirements of
this Rule (4.14.2(2)).
F. The Division does not approve terrace outslopes which are steeper than 2h:1 v
(50%). The Division does not approve of the retention of a highwall as a part
of a terrace. (4.14.2(2)(c))
G. Small depressions in the backfill may be used to minimize erosion, create or
enhance wildlife habitat, conserve soil moisture, and promote revegetation.
The Division approves their construction. (4.14.2(3))
H. The Division approves the applicant's plan for disposal of debris, acid-forming
or toxic materials, or materials constituting a fire hazard in a manner designed
to prevent contamination of ground or surface waters. A contingency plan has
also been developed to prevent sustained combustion of flammable
materials. (4.14.3(1)(a))
The Division approves the method and design specifications for covering of
acid-and toxic-forming materials in order to prevent leaching into surface and
ground water and to insure backfill stability. (4.14.3(2))
XI. Revegetation
A. The Division approves the use of introduced species in the reclamation seed
mix. The applicant has submitted information that shows that the introduced
species are desirable and necessary to achieve the approved post-mining
land use, and is not poisonous or noxious. (4.15.2(3))
B. The Division approves the use of straw mulch as a means to meet soil
stabilization requirements. The applicant will use an interim seed mix (Table
2.05.4-4) for areas that will be temporarily revegetated. (4.15.4)
C. Methods to measure herbaceous cover and production, species diversity, and
woody plant density are discussed in section 2.05.4 of the permit. These
techniques include comparison of the revegetated communities with extended
reference areas. The Division approves of these techniques. (4.15.7(1))
D. Comparisons between reclaimed and undisturbed areas, in order to
demonstrate that success criteria of 4.15.8, 4.15.9, or 4.15.10 have been met,
will be based on the following:
For grassland areas, success will be demonstrated for cover and production
when the reclaimed area is at least 90 % of the reference area and meets the
90% confidence interval using a one-sided T-test. No woody stem density
standard will apply to grassland areas. Species diversity standards are 2 cool
season grasses and 1 warm season grass comprising 5 to 30 percent of total
20
