Riprap channel lining is proposed for use to control erosion. The Division <br />approves this method of channel protection since it is necessary to <br />control erosion, it provides stability, and will require infrequent <br />maintenance. (4.05.4(2)(a)) <br />2. The permanent diversions shall make use of artificial structural controls in <br />order to allow them to remain in dynamic equilibrium with the drainage <br />basin system. The Division approves the use of such structures. <br />(4.05.4(4)(b)) <br />D. Sedimentation Ponds <br />The Division does not propose to approve the submittal of reports <br />required by Rule 4.05.6(13) on other than a quarterly basis. The report <br />submittal is quarterly. <br />2. Alternative design criteria and specifications have not been approved for <br />use in sediment pond design and/or construction at this time. (4.05.6(l 1)) <br />E. Acid-forming and Toxic-forming Spoil <br />No specific approvals are granted under this section. <br />F. Impoundments <br />The applicant has not proposed the use of alternative design criteria and <br />specifications for impoundment design and construction. (4.05.9(4)- (6)) <br />G. Surface and Ground Water Monitoring <br />1. The applicant will conduct monitoring of ground water in a manner <br />approved by the Division. The ground water monitoring plan is outlined <br />beginning on page 2.05-108 of the permit application and includes both <br />alluvial wells and bedrock wells. (4.05.13(1)) <br />2. The applicant will conduct monitoring of surface water in a manner <br />approved by the Division. The monitoring plan was submitted under <br />2.05.6(3)(b)(iv) and is outlined beginning on pages 2.05-105 of the permit <br />application and includes surface water stations, springs and seeps, and <br />stock ponds. (4.05.13(2)) <br />H. Transfer of Wells <br />At this time, New Elk Coal Company, LLC has not requested a transfer of <br />an exploration or monitoring well. (4.05.14 (3)) <br />16
