Mr. Peter Hays
September 5, 2008
Page 2
?CIVIL RES" WRCES,LI_C
5. Please indicate the proposed final offsets from all structures and property lines on the Reclamation
Plan Map.
We have added the final offsets to the Reclamation Plan Map.
6. The Division prepared a reclamation cost estimate for the Baseline Resources (AM-02) amendment.
The Division estimates the total cost to reclaim the site is $1,013,500. The Division currently holds a
reclamation bond in the amount of $1,314,888. This is a reduction of $301,388.
Hall-Irwin will submit the appropriate paperwork to ensure that the bond for this site is $1,013,500.
7. The applicant provided a slope stability analysis for this project. The applicant is required to first
attempt to reach an agreement with the persons having an interest in any structures, including utilities,
located on or within 200 feet of the affected area before providing an engineering evaluation. Please
provide the Division these notarized agreements.
Attached please find the agreement with United Power, Weld County, Merit Energy and an e-mail from Xcel
Energy stating that they do not have any structures in the area. We have made a concerted effort to enter into
an agreement with Qwest (by sending them draft agreements and having numerous conversations with them)
but have been unable to reach an agreement. As a result, we have conducted an engineering evaluation
(which we previously submitted to you) that demonstrates that no structures will be damaged by activities
occurring at the mining operation.
Thank you for your assistance with this application. Please call me if you have any questions, or require additional
information.
Sincerely,
CIVIL E OURCES,
P
Danna Ortiz
Planner
C: Jim McFarland, Hall-Irwin Corporation
Attachments: Certified Mailings Receipts
Signed Mining Plan Map and Reclamation Plan Map
United Power Agreement
Weld County Agreement
Merit Energy Agreement
Letter from Xcel
