As required by Rule 1.6.2 (1)(e), please submit the proof of the public notice circulated to all owners of <br />record of surface lands and easement holders that are on the affected land and within 200 feet of the <br />boundary of the affected land. <br />Enclosed please find the receipts for the certified mailing to Weld County, Merit Energy (formerly Bataa Oil), <br />Qwest, United Power and Xcel Energy of Colorado. Please note that the Mining Plan map now correctly <br />reflects that the James P Struck Living Trust owns the property northeast of the site as opposed to Paul A and <br />Ruth E Struck. The James P Struck Living Trust had previously received a certified mailing from us (the <br />Division has a copy of the receipt). <br />2. Rule 6.2.1(2)(b) requires that maps be prepared and signed by a registered land surveyor, professional <br />engineer, or other qualified person. The maps submitted to the Division were not signed. Please <br />resubmit a signed copy of the maps. <br />We have enclosed signed maps. <br />3. The Division received comments from the Colorado Historical Society and Colorado Division of Water <br />Resources. Please address the comments noted in the letters, and make any changes the application <br />as necessary. <br />No changes to the application are necessary. The Colorado Historical Society indicated that no cultural <br />resources inventories have taken place and no historic properties have been recorded within the proposed <br />permit area. The Colorado Division of Water Resources noted that Hall-Irwin currently has an approved <br />Substitute Water Supply Plan and well permit and they noted that we have filed an application to amend the <br />plan to reflect the proposed changes. <br />4. The Reclamation Plan indicates the proposed slurry wall will be tied into the existing Baseline <br />Resources slurry wall and the proposed Parker-Dersham slurry wall. Please explain how the slurry <br />wall will be tied into these slurry walls. <br />The slurry trenches will tie into the existing wall far enough that the trench will be at full key depth at the <br />crossing point (typically a minimum of 20' deep) and will extend a minimum of 20 feet beyond the crossing <br />point. Deere Ault, who has designed and oversaw the construction of approximately 3 water storage reservoirs <br />per year for the past decade, will have full time quality control personnel on site watching the tie in to confirm <br />the crossing are properly installed.
