III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a Partial Inspection of the Elk Creek Mine, Permit No. C-1981-022, conducted by Marcia <br /> Talvitie of the Colorado DRMS on 28-Aug-2008. Jim Kiger represented the operator, Oxbow <br /> Mining, LLC (OMLLC) during the inspection. <br /> Permitting <br /> OMLLC has received the Division's RN-5 Adequacy Review letter, but the new Cost Estimate was <br /> not attached. The Division will provide the estimate (provided on 28-Aug). <br /> Regarding TR-59, Mr. Kiger said the US Forest Service issued its proposed Lease Modification on <br /> 21-Aug-2008. The Public Notice period will be 45 days. OMLLC will provide the DRMS with <br /> electronic version for the Division's review and reference (provided on 28-Aug). <br /> The operator will soon be submitting a TR application for a new methane vent borehole. <br /> Roads <br /> Haul roads and access roads were graded throughout the facilities area. Roadside ditches <br /> were clear. <br /> Hydrologic Balance <br /> Pond A 1 -The water level was low, and no discharge was occurring. <br /> Pond B-The pond contained water, but was not full. <br /> Pond D-The water level was low in the pond, and no discharge was occurring. <br /> East Yard Pond-Material mucked from Pond D and placed in this pond to drain (as noted in the <br /> July Inspection Report) has been excavated from this pond and hauled to the Valley Fill areas <br /> for permanent placement. The East Yard Pond has been returned to its as-built configuration <br /> (Figure 1). The control valve and emergency spillway were clear. Ditches throughout the east <br /> yard appear to be recently graded and cleaned. <br /> Substation No. 3 Pond - The pond was dry, and the western two-thirds of the pond floor was <br /> bare of vegetation (Figure 2). A majority of the impoundment is well-vegetated with brome <br /> grasses, including the emergency spillway, although the far western end (perhaps consisting of <br /> material previously mucked from the pond) is covered with a mixture of Iamb's quarter, <br /> sunflower, yellow sweet clover and cheat grass. The ditch and 18" culvert which approach the <br /> pond from the west were clear, and showed signs of recent flow. <br /> Support Facilities <br /> The East Yard material storage area is neat and well-kept. The outer berm is continuous along <br /> the area, and uniform in construction and elevation. <br /> To soil <br /> The topsoil piles at Substation No. 3 and the upper fan bench are clearly marked and stabilized <br /> with desirable vegetative cover. <br /> General Mine Plan Compliance <br /> At the upper fan bench, a temporary line had been constructed to handle water being <br /> pumped from the D Seam workings to the B Seam. The original system has been re-connected, <br /> and the excavation will soon be backfilled (Figure 3). <br /> Elk Creek Mine C-1981-022 28-Aug-2008 <br /> -1- <br />
