III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during <br /> the inspection. Comments also describe any enforcement actions taken during the inspection and the <br /> facts or evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Tom Kaldenbach of DRMS. Henry Barbe of Mountain <br /> Coal Company represented the operator. Selected photographs taken during the inspection are <br /> attached to the end of this report. With the operator's consent, this report was issued from the Denver <br /> office of DRMS. <br /> The operator's representative reported that the longwall was active in Panel 25 of the B seam and <br /> development work was in progress for panel E-1 in the E seam. <br /> This inspection focused on mine disturbances in the Minnesota Creek area and new methane drainage <br /> well drilling activity over Panel E-1 (see attached photos). These areas were accessed during the <br /> inspection from the mine's main surface facilities area via the road leading south of the Materials <br /> Storage Bench which connects to the Meadow Road. The operator's contractor was drilling one of the <br /> first methane drainage wells for panel E-1. Several drill pads over panel E-1 have been constructed <br /> and are ready for drilling. The operator's contractor continues construction of the raised-bore vent <br /> shaft on the Deer Creek Shaft pad. <br /> Signs and Markers <br /> A mine i.d. sign was properly displayed on the Forest Service road at the Corrals laydown/staging area. <br /> Hydrologic Balance <br /> The ground was dry in all areas inspected. Mine water was not being discharged from outfall 017 in <br /> Sylvester Gulch. <br /> Adequate sediment control measures were in place at all locations inspected, including: the MSB <br /> stockpile, stockpile #5, the stockpile at the 1.2 million-gallon water tank, Corrals laydown/staging area, <br /> Deer Creek Shaft, and the borrow area for the Monument Dam work. A variety of sediment control <br /> measures are employed depending on location, including: straw wattles, straw bales, brush barriers, <br /> and earthen berms. <br /> Topsoil <br /> Topsoil stockpile markers were in place at all locations previously mentioned under the discussion of <br /> Hydrologic Balance. The subsoil and topsoil stockpiles are outside the fenced work area at the Deer <br /> Creek Shaft. The topsoil stockpile at the Deer Creek Shaft has recently been regraded, with subsoil <br /> and topsoil being adequately segregated. <br /> Topsoil has been stockpiled and marked at each of the recently constructed drill pads over panel E-1. <br /> 3 <br />
