Box 1849 <br />Grand Junction, Colorado 81502 <br />Dear Mr. Settle: <br />We are responding to your August 20, 2008 request for the construction of an earthen <br />dike at the Soaring Eagle gravel pit. The project is located within Sections 34 and 35, Township <br />1 North, Range 2 West, and within Section 16, Township 1 1 South, Range 101 West, Mesa <br />County, Colorado. <br />The location of the proposed dike, as depicted on the attached exhibit titled Soaring <br />Eagle Gravel Pit, dated August 20, 2008, has been determined to be upland. Accordingly, the <br />location of the proposed dike is in a non-jurisdictional area, and the proposed work will not <br />require Department of the Army authorization. Please note that other areas and components of <br />the project may be jurisdictional. <br />This verification is valid for five years from the date of this letter, unless new information <br />warrants revision of the determination before the expiration date. This letter contains an <br />approved jurisdictional determination for your subject site. If you object to this determination, <br />you may request an administrative appeal under Corps regulations at 33 CFR Part 331. <br />You should provide a copy of this letter and notice to all other affected parties, including <br />any individual who has an identifiable and substantial legal interest in the property. <br />We appreciate your feedback.
