STATE OF COLORADO
ONO
G?O
Bill Ritter, Jr., Governor
DEPARTMENT OF NATURAL RESOURCES
DIVISION OF WILDLIFE
y
AN EQUAL OPPORTUNITY E q
MPLOYER

Thomas E. Remington Director OF
6060 Broadway For' Wildlife-
Denver, Colorado 80216 For People
Telephone: (303) 297-1192
wildlife state.co us
2300 South Townsend Ave August 22, 2008
Montrose, CO 81401
Mr., Munai Shrestha
Western Fuels Association
PO Box 33424
Denver, CO 80233
Dean Murrai,
According to information relayed in a phone conversation you held with .Jim Garner on August
22, Western Fuels has implemented the DOW recommendations made in our August 1 letter regarding
the drilling of three test wells north of'Nucla., These recommendations included surveys for burr-owing
owls that maybe utilizing adjacent prairie dog colonies. My understanding is that only one of these
well locations fell within 300 feet of a prairie dog burrow and that no burrowing owls were observed
during the single site visit.. According to Jim, Western Fuels has submitted a verbal request for a waiver
on the standard timing restrictions (November 1) and would like to drill the well in late September
without initiating the full burrowing owl survey protocols..
At this time it is our opinion that the potential for any adverse impact of the drilling activity to
burrowing owls is low during this timeframe.. The odds of this particular prairie dog burrow or series of
burrows hosting an active owl nest are small. Assuming there is or was a nest at this location; it is
probable that by late September any young that might be present will have fledged and thus be capable
of avoiding the disturbance posed by the well drilling activities..
Based on these circumstances, the DOW will therefore waive the standard timing restrictions and
approves your request to drill the well in late September.,
If you have any further questions please feel free to contact me..
Sincerely,
Renzo DelPiccolo
Area Wildlife Manager - Montrose
Colorado Division of Wildlife
DEPARTMENT OF NATURAL RESOURCES, Hams D Sherman, Executive Director
WILDLIFE COMMISSION, Robert Bray, Chair • Brad Coors, Vice Chair • Tim Glenn, Secretary
Members, Dennis Buechler • Jeffrey Crawford • Dorothea Farris • Roy McAnally .
