The gully is in unconsolidated spoil <br /> material and the material appeared to have a similar composition to the material <br /> that is in the inlet of the Prospect Pond. This gully will need to be repaired. <br /> The second gully was on the north side of the Prospect Ditch and it, too, went from <br /> the top of its respective slope to the boundary with the undisturbed drainage. This <br /> gully varied in width and depth from approximately five feet deep and three feet <br /> wide to approximately ten feet deep and ten feet wide. There was some large rock <br /> that was dumped in the top portion of this gully in what was either an attempt to fix <br /> the gully or to make it into a more stable drainage. Again, this gully is in <br /> unconsolidated spoil material and the material appears to be similar to the material <br /> at the inlet of the Prospect Pond. This gully will also need to be repaired. <br /> Based on the above information, the Division believes that Colowyo is in violation of <br /> the following Rules: <br /> Rule 4.01 .1 (7) "Minimum disturbance to the prevailing hydrologic balance at the <br /> mine site and in associated off-site areas, and to quality and quantity of water in <br /> surface and ground water systems" <br /> Rule 4.05.3(1)(d) "Diversions and collection drains that are used to transport water <br /> into water-treatment facilities... Be designed, located, constructed, maintained and <br /> used so as not to increase the potential for downstream flooding, or otherwise <br /> endanger property or public safety" <br /> Rule4.05.3(1)(e) "Diversions and collection drains that are used to transport water into <br /> water-treatment facilities... Be designed, located, constructed, maintained and used <br /> to minimize adverse impacts to the hydrologic balance, and to be stable" <br /> Rule 4.05.3(3) "...permanent diversions shall be constructed to pass safely the peak <br /> runoff from a precipitation event with a 10-year, recurrent interval, or a larger event <br /> as specified by the Division for good cause shown. Permanent diversions shall be <br /> constructed with gently sloping banks that are stabilized by vegetation. Asphalt, <br /> concrete, or other similar linings shall be used only when approved by the Division to <br /> prevent seepage or to provide stability" <br /> Rule 4.05.3 (4) "Diversions shall be designed, constructed, and maintained in a <br /> manner which prevents additional contributions of suspended solids to streamflow <br /> and to runoff outside the permit area, to the extent possible using the best <br /> technology currently available..." <br /> Rule 4.05.3 (7)(a) "Diversion design shall incorporate the following... Channel linings, <br /> including channel riprap, shall be designed using standard engineering practices to <br /> pass safely the design velocities" <br />
