Provide adequate capacity to contain <br /> or treat the runoff or inflow entering the pond as a result of 10-year, 24-hour <br /> precipitation event..." <br /> Rule 4.05.6(3)(c) "Sedimentation ponds and other treatment facilities shall be <br /> designed, constructed and maintained to... Provide a nonclogging dewatering <br /> device or conduit spillway to remove water storage resulting from inflow..." <br /> Rule 4.05.9(2)(b) "If the impoundment is designed and constructed with a <br /> combination of a principal and emergency spillways, there shall be no out-flow <br /> through the emergency spillway during the passage of runoff resulting from the <br /> 10-year 24-hour precipitation event, regardless of the volume of water and sediment <br /> directed to the impoundment from any underground workings or surface pit" <br /> Rule 4.05.9(2)(c)(ii) "...) the applicable design precipitation event used to size <br /> impoundment spillway systems shall be... the 25-year, 24-hour precipitation event, or <br /> a larger event specified by the Division..." <br /> Rule 4.05.9(10) "All impoundments shall be designed, constructed, and maintained <br /> with adequate freeboard to prevent overtopping by waves or by sudden increases in <br /> volume..." <br /> In addition to CV-2008-004, which was issued as a result of the 13 August 2008 <br /> inspection, violation CV-2008-003 remains outstanding. Notice of Violation CV-2008- <br /> 003 was issued for a failure to obtain proper approval for the designs of the Section <br /> 16 Pond Ditch extension and failure to demonstrate compliance with Rule 4.05.9(2) <br /> for the Section 16 Pond. <br /> The abatement for this violation is as follows: <br /> 1 . Obtain proper approval for the Section 16 Pond Ditch extension from the <br /> Division. <br /> 2. No construction on the ditch may be resumed until proper approval is <br /> obtained. <br /> 3. No water may be directed into the Section 16 Pond ditch extension until <br /> proper approval is obtained. <br /> The abatement must be completed on or before 15 September 2008. <br />
