Rule 4.05.6(3)(a) "Sedimentation ponds and other treatment facilities shall be
designed, constructed and maintained to... Provide adequate capacity to contain
or treat the runoff or inflow entering the pond as a result of 10-year, 24-hour
precipitation event..."
Rule 4.05.6(3)(c) "Sedimentation ponds and other treatment facilities shall be
designed, constructed and maintained to... Provide a nonclogging dewatering
device or conduit spillway to remove water storage resulting from inflow..."
Rule 4.05.9(2)(b) "If the impoundment is designed and constructed with a
combination of a principal and emergency spillways, there shall be no out-flow
through the emergency spillway during the passage of runoff resulting from the
10-year 24-hour precipitation event, regardless of the volume of water and sediment
directed to the impoundment from any underground workings or surface pit"
Rule 4.05.9(2)(c)(ii) "...) the applicable design precipitation event used to size
impoundment spillway systems shall be... the 25-year, 24-hour precipitation event, or
a larger event specified by the Division..."
Rule 4.05.9(10) "All impoundments shall be designed, constructed, and maintained
with adequate freeboard to prevent overtopping by waves or by sudden increases in
volume..."
In addition to CV-2008-004, which was issued as a result of the 13 August 2008
inspection, violation CV-2008-003 remains outstanding. Notice of Violation CV-2008-
003 was issued for a failure to obtain proper approval for the designs of the Section
16 Pond Ditch extension and failure to demonstrate compliance with Rule 4.05.9(2)
for the Section 16 Pond.
The abatement for this violation is as follows:
1 . Obtain proper approval for the Section 16 Pond Ditch extension from the
Division.
2. No construction on the ditch may be resumed until proper approval is
obtained.
3. No water may be directed into the Section 16 Pond ditch extension until
proper approval is obtained.
The abatement must be completed on or before 15 September 2008.
