III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Kent Gorham of the Colorado Division of <br /> Reclamation, Mining, and Safety (Division). This mine is in permanent cessation and <br /> reclamation of most areas is complete. Ground conditions on this day were wet and muddy <br /> due to a recent rain. The weather was seasonal and mild. George Patterson of Energy Fuels <br /> Coal Inc. (EFCI) accompanied me on the inspection. <br /> Availability of Records <br /> The public copy of the mine records is kept at the Energy Fuels Coal Company office in <br /> Florence. Specific detail regarding the records inspection can be found on page 2a of this <br /> report. All other records were found in compliance. <br /> Hydrologic Balance <br /> Pond 4 and pond 5 (shown below, respectively) both held water due to a rain event the <br /> previous afternoon. This is likely the most water that pond 5 has held since the mine site <br /> was reclaimed. Neither pond was discharging. The inlet to pond 5 showed no evidence of <br /> downcutting due to the storm inflow. Both pond embankments and spillways appeared in <br /> good condition with no problems observed. <br /> vt <br /> Processing Waste <br /> The refuse disposal pile appeared normal with no sign of slumps, slides, or damage of any <br /> kind. <br /> Revegetation <br /> Reoccurring rainfall over the last few weeks has resulted in a general green-up of the <br /> reclaimed area. Grasses and forbs are responding accordingly after a very dry spring and <br /> 3 <br />
