III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> for dust control. A small area (1/3 acre) of ground had been disturbed for the creek access and <br /> pump placement, and silt fence had been installed around the perimeter. During the <br /> inspection, the fence installation was improved by the reclamation contractor. The topsoil pile <br /> along the southern side of the pile has not been disturbed by reclamation activities, and is <br /> marked. The pond held a small amount of water. <br /> Well Field <br /> There has been no disturbance at the well field, but BRL indicated that a land swap agreement <br /> with Pitkin Water may occur at some future date. <br /> Exploration Holes <br /> BRL has not commenced work associated with two wells approved under TR-49. <br /> West Mine <br /> A severe thunderstorm struck during the inspection; associated rainfall resulted in the road to the <br /> West Mine being impassable. The operator stated that they have diligently searched for the <br /> tension crack observed on the reclaimed slope during the 22-Apr-2008 inspection, but have <br /> been unable to locate it, as yet; it may have "healed" itself, but they will continue to search. <br /> BRL stated that weed control efforts have been effective at the West Mine, and that silt fence <br /> and drainage issues observed in April are being addressed. <br /> East Mine <br /> The rainstorm caused hauling and compaction activities to be shut down for the remainder of <br /> the afternoon. Hauling of backfill to the uppermost bench has continued. Demolition of the <br /> surge bin was under way, with an impact hammer attached to an excavator. The concrete will <br /> be removed to an elevation 4 feet below the final reclamation contour, an the steel will be <br /> recycled. <br /> The West Ridge Pond and Ponds 3 and 4 were dry. <br /> Bowie No. 1 Mine C-1981-038 28-Jul-2008 <br /> -2- <br />
