III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a Complete Inspection of the Bowie No. 1 Mine conducted by Marcia Talvitie of the <br /> Colorado DRMS on 23-July-2008. Basil Bear represented the operator, Bowie Resources LLC <br /> (BRL), during the inspection. The weather was initially sunny and hot, but a severe afternoon <br /> thunderstorm prevented access to the West Mine. <br /> Availability of Records <br /> Records were available for viewing at the BRL office located at the Bowie No. 2 Mine. A <br /> completed "DRMS Availability of Records" form is attached. <br /> Signs and Markers <br /> Mine and Permit ID signs and perimeter markers were posted and in-place as required by Rule <br /> 4.02 at the Highway Coal Stockpile Facility, the Loadout Facility, the East Mine and the West <br /> Mine. The operator's address displayed on the various signs may no longer be valid? <br /> Highway Coal Stockpile Facility <br /> The access road was dry, and a train of empty cars was stored on the railroad tracks adjacent <br /> to the area. The pond was dry, but did contain numerous tumbleweed carcasses. The <br /> vegetative cover appeared to be fair, and of uniform distributionA No noxious weeds were <br /> observed. (Fig./) <br /> Loadout Facility (FI5.Z) <br /> All three accesses to SH 133 are paved, and in good to fair condition. A scale use, set of truck <br /> scales, and concrete pad remain in place on the southernmost access road. The culvert pipe <br /> immediately north of the scales was clear. At the middle access, the culvert that passes "clean" <br /> water beneath the road appeared to be obstructed at both ends. However, it did not appear <br /> (based on the vegetation) that the ditch carries much flow (if any). Nonetheless,the culvert inlet <br /> and outlet should be cleared. <br /> Vegetation in southern end of the loadout area is thriving. Grasses, including brome and slender <br /> wheat, and alfalfa are abundant. The topsoil pile is clearly marked. <br /> The outer berm at the upper and middle material storage areas are intact, and empty <br /> petroleum storage tanks observed on previous inspections have been removed. On the lower <br /> level, the ditch parallel to the railroad tracks has been regarded to better send flow through the <br /> (Ff5 culver o e sediment pond. The pond was dry and overgrown with vegetation. The <br /> standpipe was clear, and there was no sign of recent discharge. The emergency spillway was <br /> partially blocked with shrubs; the operator stated that they would be cleared out. <br /> BRL has been actively and successfully controlling weeds within the loadout area. Thistle <br /> (Frg.3)carcasses, previously sprayed, were observed on the downslope side of the material storage <br /> area berm. A colony of Russian knapweed has become established among casing pipe <br /> stockpiled north of the substation (Figure). The operator stated that this site will be incorporated <br /> into the company's continuing weed control efforts. <br /> R.O.M. Pile <br /> The haul road was dry and in good condition. No additional material has been hauled from the <br /> R.O.M. Pile to the East Mine. The creek in Stevens Gulch was being utilized as a source of water <br /> Bowie No. 1 Mine C-1981-038 28-Jul-2008 <br /> - 1 - <br />
