applicant should identify the trigger(s) that will determine whether the installation of <br />the drain is needed. <br />17. Specify whether explosives will be used during mining per Rule 6.4.4(1). <br />6.4.5 EXHIBIT E - Reclamation Plan <br />18. The Mining Plan indicates that the pit will be mined at a 3H: IV slope. However, the <br />Reclamation Plan calls for backfilling the slope. Please clarify why the slopes will <br />need to be backfilled if the pit is mined leaving 3H: IV slopes. <br />19. The Reclamation Plan calls for replacing the topsoil to a depth of six inches. The <br />Division recommends replacing topsoil to a depth of twelve inches. The affected area <br />will be primarily surface water when reclamation is complete. This will provide the <br />operator with a sufficient amount of topsoil, so as to replace it to a depth of twelve <br />inches. Please commit to using twelve inches of topsoil. <br />20. The applicant indicates that the topsoil stockpiles will be seeded if they sit longer than <br />one growing season. Please specify the seed mix to be used on the topsoil stockpiles <br />per Rule 6.4.5(f)(ii). <br />21. Include as part of the Reclamation Plan the type and amount of fertilizer to be used <br />for revegetation per Rule 6.4.5(f)(iii). <br />22. The Reclamation Plan calls for covering the seeded areas with straw mulch at a rate <br />of 2,000 pounds per acre. The Division recommends using 4,000 pounds per acre. <br />23. The Reclamation Plan states that inlet and outlet facilities for the reservoir will be <br />designed when the end use of the reservoir is identified. Please provide the Division <br />with the general location of these structures and identify them on the Reclamation <br />Plan map. If the location of these structures needs to be changed, it can be done by <br />submitting a technical revision to the Division. <br />24. As required by Rule 6.4.5(2)(e), please provide a detailed timetable for reclamation. <br />Include estimates for the amount of time to complete each phase of reclamation, a <br />description of the size and location of each area to be reclaimed during each phase, <br />and an outline of the sequence in which each phase of reclamation will be carried out. <br />25. The applicant indicates that a surface use agreement is expected to be made with the <br />pertinent oil and gas companies regarding the existing well in the middle of the <br />affected area. Without an actual agreement in place, the Reclamation Plan must <br />reflect reclamation with the well and setback in place. The Reclamation Plan Map <br />that was submitted could be used as an alternate plan if an agreement to remove the <br />well is reached. Please revise the Reclamation Plan accordingly.
