Please remember that the decision date for this
application is August 30th, 2008. If you are unable to satisfactorily address any concerns
identified in this review before the decision date, it will be your responsibility to
request an extension of the review period. If there are outstanding issues that have not
been adequately addressed prior to the end of the review period, and no extension has
been requested, the Division will deny this application.
Overall, your response answered the majority of the concerns raised during the initial
adequacy review. Upon review of your responces and a second review of the application
several other issues will need to be addressed prior to the approval of the permit.
Items regarding the response to the Divisions adequacy review:
Exhibit E - Reclamation Plan:
Item B.- Final land use for the "Special Overlap Zone"
For your information and to clarify the Divisions position regarding this overlap
zone, the Division will accept your plan to stabilize and prepare the area for
highway construction as adequate, to fulfill the post mine land use designation of
"Industrial/Commercial". Also, the Division agrees with you that a secondary
plan should be in place to revegetate this area with the same specifications of the
Office of Office of
Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
