II. Hydrologic Balance - Rule 4.05 <br />A. Stream Channel Diversions <br />1. The Division proposes to approve a permanent diversion. This diversion is consistent <br />with applicable state law, will not diminish downstream water rights and meets the <br />requirements of Rule 4.05.4 (4.05.4(4)). <br />C. Surface and Ground Water Monitoring <br />Prior to 2006, the applicant monitored the quality and level of ground water in wells <br />178, 94-1, and 95-1. The application for Technical Revision 13 demonstrated that: a) <br />the operation has minimized disturbance to the hydrologic balance in the permit and <br />adjacent areas, b) material damage to the hydrologic balance outside the permit area <br />has been prevented, and c) water rights of other users have been protected. Based on <br />this demonstration, the ground water monitoring plan was deleted (4.05.13(1)). <br />a. The baseline data results are discussed and tabulated in appendix 4-3 of the <br />permit application. <br />2. The applicant will conduct monitoring of surface water in a manner approved by the <br />Division. The monitoring plan was submitted under 2.05.6(3)(b)(iv) and includes the <br />following: (4.05.13(2)). <br />a. Baseline data and results are included in Appendix 4-3 of the permit. <br />b. Three springs, (1,3, and 4) were monitored prior to 2006. Monitoring of these <br />springs was deleted in TR-13 based on the demonstration described in the <br />preceding discussion of ground water. <br />c. NPDES sites (sediment pond outlets) will have monthly maintenance, service, <br />flow measurements, field parameters, and quarterly full suite water quality <br />samples. <br />III. Sealing of Drilled Holes and Underground Openings <br />A. The Division will require that each hole, well or other underground opening be capped, <br />sealed, or otherwise properly managed (4.07.3). <br />IV. Disposal of Excess Spoil <br />A. The Division is proposing to approve the use of a disposal area for excess spoil (4.09.1(1). <br />B. The Division has reviewed the design for the fill and has previously approved it (4.09.1(2)). <br />C. The Division has approved of the location of the disposal area (4.09.1(6)). <br />D. The underdrain system was constructed simultaneously with excess spoil placement by the <br />natural segregation of dumped materials. The resulting underdrain system is capable of <br />carrying anticipated seepage from rainfall as well as springs and seeps within the <br />13
