III. COMMENTS - COMPLIANCE <br /> Eagle Mines C-1981-044 <br /> 22 July 2008 <br /> Pg 1/2 <br /> Below are comments on the Inspection. The comments include discussion of observations <br /> made during the inspection. Comments also describe any enforcement actions taken during <br /> the inspection and the facts or evidence supporting the enforcement action. <br /> This was a complete inspection of the Eagle Mines conducted by Jim Stark of <br /> CDRMS. Jerry Nettleton of BTU-Empire accompanied me on the inspection. The mine <br /> is currently in temporary cessation and is only performing maintenance and <br /> monitoring activities. The inspection was conducted on 22 July 2008. The weather <br /> was hot and sunny and the ground was dry. The areas of the mine that were flooded <br /> from the spring run-off in the Williams Fork and Yampa Rivers have all dried up and <br /> the flows appear to have returned to normal. <br /> Availability of Records: All of the necessary records were available. The records were <br /> brought to the inspection in a box by Jerry Nettleton. Please see the DRMS <br /> Availability of Records form at the end of this inspection for more detailed <br /> information. <br /> Signs and Markers: - All of the necessary signs were in place as required. The <br /> entrances along Colorado Highway 13 all have their appropriate signs. Stream buffer <br /> zone (and buffer zone exemption) signs were also in place as required. <br /> Roads: - The mine access road was dry and in good condition. The road is well <br /> maintained and appeared stable at the time of the inspection. There were no <br /> erosional problems noted on the road at the time of the inspection. <br /> - The access roads on the east side of the mine were all dry. All of the roads were <br /> well maintained and appeared to be stable at the time of the inspection. <br /> Hydrologic Balance: - The Mine 5 dewatering ponds, 5-P5, 5-P6 and 5-P7, all <br /> contained water and were all stable and well vegetated at the time of the <br /> inspection. The ponds were discharging into the Williams Fork at a rate of <br /> approximately 5 GPM and the discharge looked clear. There did not appear to be <br /> any muskrat holes or erosional problems in the pond embankments at the time of the <br /> inspection. <br /> - Sediment Ponds 9-P7 and 9-P8, by the old B&S building, were both dry at the time <br /> of the inspection. The pond embankments were all well vegetated and stable at the <br /> time of the inspection and there were no signs of erosion. <br /> - Sediment Pond 9A-P1 was dry at the time of the inspection. The pond embankment <br /> was well vegetated and appeared to be stable. No erosional problems were noted <br /> on the pond embankment at the time of the inspection. <br /> - Sediment Ponds 9-P2 and 9-P3 are a series of ponds on the east side of the site for <br /> old, reclaimed areas. Both ponds were dry at the time of the inspection. Both pond <br /> embankments were well vegetated and appeared to be stable at the time of the <br /> inspection. No erosional problems were noted on either pond embankment at the <br /> time of the inspection. <br />
