III. Comments - Compliance <br /> Below are particular issues with regard to any of the above compliance items. <br /> Enforcement actions resulting from failure to comply with the Act, Rules and <br /> Regulations, and the permit also are identified below. <br /> 1 . The preparation plant slurry pond (thickener pond) has not yet been <br /> cleaned out. No environmental damage has resulted. A very small quantity of <br /> sediment has accumulated in the pond since it was noted as a problem in the <br /> July Inspection Report. Slurry material not contained within the slurry pond <br /> would be contained by the sediment control system for the wash plant-shop <br /> area. Since the potential for environmental damage is negligible given the <br /> rate of slurry production and containment by the sediment control system, an <br /> NOV will not be issued. The abatement deadline for this problem (017-82-29) <br /> has previously been extended due to weather conditions and equipment <br /> problems. The abatement deadline will not be extended further, but an NOV <br /> will not be issued for failure to clean out the slurry pond unless the <br /> situation contributes to environmental degradation. <br /> 2. The Mine No. 2 Coal Stockpile has been removed. Problem 017-82-25 <br /> notes coal spillage in the undisturbed area below the stockpile and specifies <br /> that coal be cleaned up when the stockpile is removed. Mr. Bowman requested <br /> that the compliance deadline be extended until after snowmelt so that coal <br /> clean-up could be accomplished without causing unnecessary damage to <br /> vegetation in the undisturbed area below the stockpile. Since the stockpile <br /> may be replaced prior to snowmelt it will be necessary to maintain a buffer <br /> between the undisturbed area and stockpiled coal to allow room for equipment <br /> to enter the area and remove the coal from the undisturbed area. It was <br /> agreed that this would be acceptable, and further, that the buffer strip would <br /> be maintained to allow future clean-up and that a berm would be rebuilt along <br /> the outside of the buffer strip upon completion of clean-up. <br />
