Our interpretation of the commitment is that the silt fence between the <br />sediment pond location and the creek (depicted on Figure 2.2-3), will be installed <br />prior to sediment pond construction and maintained until the sediment pond <br />disturbance area is stabilized by an effective interim vegetation cover. <br />Rule 2.06.8 Alluvial Valley Floors <br />59. The Division made several requests pertaining to updated alluvial valley floor <br />boundary information pertinent to proposed TR-16 operations. All of the Items <br />originally labeled as 59a) through 59e) have been resolved with exception of Item <br />59c), as set forth below: <br />c) Please update the narrative description of existing and proposed disturbance on <br />the AVF, on permit pages 4-6 and 4-7, of Section 4.1.2.5, to incorporate proposed <br />TR-16 disturbances. Note that the existing narrative indicates (apparently <br />erroneously) that "the existing sediment pond, topsoil stockpile, and proposed <br />riprap storage area" are located on the AVF. <br />New narrative was provided on amended pages 4-6 and 4-7, incorporating <br />proposed TR-16 disturbances. The new discussion regarding acreage associated <br />with the proposed disturbance is somewhat confusing, as there is a statement <br />indicating that approximately two acres of disturbance will occur on the AVF, <br />followed immediately by an accounting of 4.5 acres of disturbance associated <br />with individual facilities. Based on Figure 4.1-2, some portion of the cited <br />disturbance (e.g. the coal mine waste pile and some or all of the proposed new <br />construction material stockpile) appear not to be located on the AVF. Please <br />provide clarification regarding disturbed acreage on the AVF; disturbance <br />acreages listed for individual facility disturbances on the AVF should add up <br />to the total disturbance acreage on the AVF, and should conform with the <br />AVF boundaries and facility disturbances as depicted on Exhibit 4.1-2. <br />New Items A through E regarding revised figures submitted with the May 21, 2008 <br />Response package are given below. <br />A. Figure 2.2-1- Affected and Disturbed Areas <br />The lease boundaries are clearly delineated by purple dashed lines, but the permit <br />boundary is missing from this map. Please add the permit boundary. <br />There is an un-labeled, mostly continuous red line that approximately follows the <br />5600' to 5800' elevation from north to south through the area shown. Please <br />identify this line or remove it from the figure. <br />B. Figure 2.2-2 - Surface Facilities <br />The term "Gob Pile" is still used to identify the Coal Mine Waste Pile. Please <br />correct the label. Page 2-32 describes Light Use Road #3, but we are unable to <br />locate the road on this map. Please provide the location of Light Use Road #3.
