Their response also addresses DOW concerns with the sediment pond, <br />and indicates that lining of the sediment pond is not warranted. Further, the <br />operator agrees to realign the BLM Drift Fence and the current design provides <br />for a 5:1 ramp on the east side of the sediment pond that could be used by wildlife <br />as an escape. <br />The Division will forward the operator's response and amended Appendix N <br />to DOW for their review. <br />Rule 2 05 6(3) Protection of the Hydrological Balance <br />53. The operator was requested to add a discussion of the pond drainage and sediment <br />pond discharge to the PHC analysis in Appendix N. Given the close proximity of <br />the proposed pond to East Salt Creek, the operator was also asked to include an <br />assessment of the need for installation of a protective clay liner in the pond, and <br />include such design modification as appropriate. The operator modified <br />Appendix N to include a discussion of the existing sediment pond with regard to <br />infrequent discharge and low conductivity, and concluded that the impact of the <br />sediment pond is disregarded. <br />Further PHC analysis and modifications to Appendix N may be required, <br />pending resolution of Item #52 (see above) regarding DOW's comment letter <br />concerning the quality of water discharged from the pond, potential for <br />leaching contaminates into the ground water, and the potential need for a <br />pond liner. <br />58. The Division noted that the proposed sediment pond will be located within 100 <br />feet of a stream with a drainage area of greater than 1 square mile (East Salt <br />Creek). As such, the provisions of Rule 4.05.18 (Stream Buffer Zones) apply. <br />Operator was requested to provide narrative addressing compliance with <br />4.05.18(a) and (b) and to delineate the East Salt Creek buffer zone on Figure 2.2- <br />3. <br />Item Resolved.
