5. If reasonable assurance of industrial/commercial use in the near future can be documented, <br />DRMS agrees that the proposed reclamation plan revisions regarding: 1) removal of the topsoil <br />replacement and revegetation requirement on the pit floor (providing a stabilizing layer of gravel <br />is retained) and; 2) creation of 2H:1 V final pit slopes (providing stability can be demonstrated) <br />can be considered. Topsoil depth on the pit slopes will still be required at a minimum 6 inch <br />depth to which Grand County previously agreed. <br />If reasonable assurance cannot be provided, DRMS will require application of 6 inches of topsoil <br />on the entire disturbed area of the current permitted area and 4 inches across the disturbed area <br />added to the permit through AM-01 (though 6 inches is strongly recommended if growth <br />medium is available), and revegetation of the entire area disturbed by mining. <br />6. Please double the proposed seed mix application rate to bring the seed density up near the NRCS <br />recommended rate of 40 seeds per square foot. <br />7. Please ensure the reclamation map correctly portrays the proposed final land use for each portion <br />of the affected lands. <br />8. The legal description on the Warranty Deed submitted as proof of right-to-enter in Exhibit N <br />does not include the area proposed, in AM-01, to be added to the permit. Please submit adequate <br />proof of right to enter and mine this proposed area, per the requirements of 6.4.14. <br />9. Please revise Exhibit S to address all the requirements of Rule 6.4.19. If the Geotechnical <br />Stability Exhibit is to be used to demonstrate stability of the permanent man-made structures, <br />please state that in Exhibit S. <br />10. A general statement regarding approximate stability of most gravels is not acceptable as an <br />engineering demonstration of stability unless it includes a statement or documentation verifying <br />there are no known geologic hazards in the vicinity. To verify there will be no adverse affects to <br />adjacent permanent man-made structures, please provide adequate specifications regarding the <br />nature of the site deposit, dimensions of potential slope failures and locations of all structures <br />within 200 feet of the proposed affected area relative to the maximum extent of the calculated <br />potential failures. <br />If you need additional information, please contact me at the Division of Reclamation, Mining and <br />Safety, Grand Junction Field Office, 101 South Third Street, Room 301, Grand Junction, Colorado <br />81501, telephone no. 970-243-6368. <br />Sincerely, <br />Steve S.
