<br />Seal - Figure 8" is shown on page 2.05-37 of the November 13, 1981 application. Incidentally, the Exhibit
<br />3 Hydrology/Geology report from the February 4, 1981 application is renumbered Exhibit 6 in the
<br />November 13, 1981 application.
<br />On April 19, 1982, MLRD sent CF&I a "working draft Findings Document" for the Maxwell Mine, File No. C-
<br />013-81. CF&I provided its responses to the draft Findings Document on August 24, 1982 and December
<br />20, 1982.
<br />On November 23, 1983, a draft Findings Document for the Maxwell Mine, File no. C-013-81 was sent by
<br />MLRD to Mike Kolin of Wyoming Fuel Company. On November 25, 1983, the MLRD received a letter from
<br />CF&I Steel Corporation that states, "This is to inform you that CF&I and Wyoming Fuel Company have
<br />signed a sales agreement on the Allen and Maxwell mines and that CF&I desires your Division to take
<br />whatever measures are necessary in order to make Wyoming Fuel Company a co-applicant on the Allen
<br />and Maxwell mine permit applications".
<br />• On December 14, 1983, MLRD proposed to partially approve the Maxwell mine permit, naming CF&I as
<br />the applicant. The associated public notice ran on December 15, 1983 and December 22, 1983. The
<br />public notice stated that any requests for a Formal Public Hearing were to be submitted by January 13,
<br />1984.
<br />• A letter dated December 20, 1983 from Wyoming Fuel Company to MRLD states, On December 15, 1983,
<br />Wyoming Fuel Company completed purchase of the Maxwell and Allen coal mines from CF&I Steel
<br />Corporation in Las Animas County, Colorado. We have renamed these mines the Golden Eagle (formerly
<br />Maxwell) and the New Elk (formerly Allen)."
<br />• On January 31, 1984, the MLRD approved a transfer of permit number 77-374 for the former Maxwell Mine
<br />from CF&I Steel Corporation to Wyoming Fuel Company. Also on January 31, 1984, a "Mining Permit-
<br />Coal" for Wyoming Fuel Company for the Golden Eagle Mine was signed. This permit was numbered C-
<br />013-81 and was given an issuance date of January 25, 1984.
<br />• On January 15, 1993, MLRD proposed its decision to approve the transfer of permit number C-013-81 from
<br />Wyoming Fuel Company to Basin Resources, Inc. This proposed decision became final with the signing of
<br />the transfer of permit document by MLRD Director Long on April 21, 1993.
<br />• On March 31, 2008, DMRS proposed its decision to approve the transfer of permit Number C-1981-013
<br />from Basin Resources, Inc to New Elk Coal Company, LLC. The proposed decision became final on April
<br />29, 2008.
