Michael Boulay May 21. 2008 <br />been reclaimed and information in amended sections of the application indicates <br />that rock waste disposal underground is no longer approved by MSHA. <br />Please provide an amended page with properly updated narrative. <br />CAM: Please see updated page 2-1 that removed the reference to the Munger <br />Canyon Coal Mine Waste Pile and references the Coal Mine Waste pile being <br />applied for by this technical revision application. <br />3. DRMS: There is a statement in the first paragraph on page 2-2 of the <br />currently approved permit indicating that "no surface borings or drill hole <br />programs are planned within the permit area..." that could be somewhat <br />misleading, as there has been limited surface drilling for wells, waste disposal <br />foundation investigation, and an emergency monitoring hole into the workings <br />following a mine explosion. <br />Please provide amended narrative with appropriate clarification. <br />CAM: It is the assumption of the Operator that at the time of the writing of the <br />permit application, no holes were planned for the permitted area, however, page <br />2-2 states, 'If there is a need for surface drilling within the permit area, the hole(s) <br />will be managed in accordance with Section 4.07, Rules and Regulations of the <br />Colorado Mined Land Reclamation Board and 30 CFR 211'. Therefore, the <br />holes that have been drilled and could be drilled in the future are covered by that <br />statement. <br />4. DRMS: Language in the second paragraph of page 2-23 appears dated <br />(reference to lease area rather than permit area, and mention of work area and <br />road construction as the only surface disturbances). <br />Please provide amended narrative regarding existing and proposed surface <br />disturbances within the permit area. <br />CAM: Please see updated page 2-23 updating the disturbance effects on the <br />surface waters of and near the permit area. <br />5. DRMS: Various sections of narrative under Section 2.2 Surface Facilities of <br />the approved permit application are outdated, and need to be amended to <br />incorporate changes proposed in TR- 16, including reference to disturbance <br />acreage in the canyon mouth area in the first paragraph of page 2-26 (should <br />include the office area disturbance and TR- 16 disturbances), sediment drying <br />area references in the first paragraph on page 2-27, and commitment regarding <br />coal waste disposal area TR submittal in the second paragraph of page 2-27. <br />Please submit properly amended narrative. <br />3
