Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Reclamation, Mining and Safety (Division) has reviewed the adequacy response <br />submittal from SCC dated March 3, 2008. We have the following remaining comments regarding this <br />permit revision application. <br />Items 1-6. Responses accepted. <br />7. This comment is related to Item 10 below. Prior to approval of PR-4 we will require written <br />comments from State and local government agencies which would have to initiate, implement, <br />approve, or authorize the proposed use of the land following reclamation [Rule 2.05.5(1) b)]. <br />As indicated in your response, SCC has sent the Mesa County Department of Planning & <br />Development a letter requesting comments or concerns regarding the proposed post mining <br />land use, and to date SCC has not received a response to the letter. We recommend that SCC <br />again contact the Mesa County Department of Planning and Economic Development to <br />obtain their comments on the proposed plan. <br />Items 8-9. Responses accepted. <br />10. As indicated in your response, Halliburton is in the process of submitting an application for a <br />Mesa County Department of Planning and Economic Development Conditional Use Permit <br />(CUP). The Mesa County CUP will need to be obtained before the Division can issue a <br />Proposed Decision on PR-4. <br />Items 11-14. Responses accepted. <br />New Items 15 and 16 were added by SCC in the March 3, 2008 response submittal.
