RE: Carbon Junction Mine Phase I Bond Release Calculation Errors Page 2 of 2 <br />Subject: Carbon Junction Mine Phase I Bond Release Calculation Errors <br />Tom, <br />I have reviewed your a-mail and the attached spreadsheet and have some concerns about the way the Division is portraying <br />and assessing the remaining liability at the Carbon Junction Mine. While the Division is constrained in the amount of <br />financial bond that may be released during Phase I, the Division may not assert that tasks that have been completed are being <br />bonded for, as is the case in your spreadsheet. For the record, the following tasks identified in the spreadsheet were <br />completed in 2006; 001-010 (inclusive), 012-017 (inclusive), 018-021 (inclusive), 022-028 (inclusive), 038, 039, 041, 043- <br />045 (inclusive), and 052. The Division is not legally allowed to assess bond for these tasks as they have already been <br />completed. To allow the Division to asssess costs for these tasks would indicate Oakridge's and my agreement that additional <br />work remained to complete these tasks, with attendant legal liability and responsibility. Therefore the completed tasks must <br />be removed from any CDRMS bond calculation. Further, Tasks 050 and 051 indicate activities that may/will occur over a <br />ten year liability period. As you know, the ten year liability period applies to mines with post-mining land uses of wildlife <br />habitat and rangeland. This does not apply in the Carbon Junction Mine case, where the post-mining land uses reflect <br />residential and commercial uses. These tasks must be revised to reflect atwo-three post reclamation liability, as that is the <br />expected time that the mine will remain under CDRMS jurisdiction. <br />Please provide me with the revised calculations as soon as possible. <br />Michael Savage <br />4/17/2008 <br />
