IV. Problems., Recommendations and Compliance Dates The operator is advised that the following problems have been identified during inspections and that failure to correct the problems may result in the Division taking an ENFORCEMENT ACTION pursuant to CRS 1973, as amended, 34-33-123. (Recommendations and compliance dates are to be clearly noted. Dates are to be. specific, e.g. , January 31 , underlined.) 1983 and 017-83-12 Repair the berm on the outside edge of the Mine 4 road by October 17 1983. 017-83-13 Clean the slurry from the undisturbed area outside the slurry pond west of the wash plant and rebuild the embankment so a minimum of one-foot of freeboard above the level of the emergency spillway is maintained. This work must be completed by November 15, 1983. 017-83-14. Sediment pond 006 must be cleaned by October 17, 1983. 017-83-15 The erosion on the road above sediment pond 006 must be repaired by October 24 1983. 017-83-16 The drainage ditch below the north side of the Mine 1 stockpile must be cleaned by October 17, 1983. 017-83-17 Restore the berm around the Rock Tunnel (powder magazine by October 17, 1983. 017-83-18 Build a berm along the south side of the ramp/road to the artic circle pump to direct drainage into the artic circle ponds by October 17, 1983. 017-83-19 Redefine the Mine 5 disturbed drainage ditch on the south side of the lower pad by October 17. 1983. 017-83-20 Extend the berm to the warehouse pond along the edge of the storage area south of the warehouse by October 24 1983. 017-83-21 Regrade the topsoil stockpile above the Mine 1 coal stockpile and erect a topsoil marker by October 24, 1983. The following problem is still in the process of resolution. 017-83-8 Remove the' coal that is beyond the berm on the southwest corner of the Mine No. 2 coal stockpile as soon as the s-tockpile is sufficiently small enough to facilitiate removal of the fugitive coal .
