III. Comments - Compliance <br /> Below are particular issues with regard to any of the compliance items . <br /> Enforcement actions resulting from failure to comply with the Act, Rules <br /> and Regulations, and the permit also are identified below. <br /> 4.02- Signs and Markers <br /> The perimeter markers have been changed as requested in the previous <br /> inspection. The old permit number (77-419) has been erased from the <br /> signs. <br /> 4.03 Roads <br /> 1 ) The berm on the outside edge of the Mine 4 road should be repaired <br /> to keep water from flowing over the road embankment. It was evident that <br /> water had breached the. berm in several places . <br /> 2) Several culverts were found to be plugged at the inlet. These <br /> culverts are: <br /> a) The first culvert below Mine 4 <br /> b) The first culvert below Mine 1. <br /> c) The first culvert north and the first culvert south of Coal <br /> Creek on the Mine 5 road. <br /> d) The first culvert above the Rock Tunnel on Mines 3 and 5 road. <br /> In addition, the inlets to the culverts below the lower bin of Mine 3 <br /> must be repaired, and the second culvert above the Rock Tunnel on the <br /> Mines 3 and, 5 road must be plugged-. <br /> 4.04 Support Facilities. <br /> Thickener from the wash plant had been purged into the slurry pond <br /> directly west of the wash plant just prior to or at the beginning _of this <br /> inspection. Some of the slurry material had overtopoed a low spot in the <br /> embankment of the impoundment on the northwest side. This slurry flowed <br /> into an undisturbed area (tree grove) near the pond. The overflow area <br /> measured approximately 20 ft. x 30 ft. with approximately 6 inches of <br /> slurry around the trees. Notice of Violation No. 83-27 was issued for <br /> failure to maintain the impoundment. <br /> 4.05 Hydrologic Balance <br /> 1 ) The berm on the south side of the Mine 2 coal stockpile had been <br /> extended to direct runoff water away from Dutch Creek. <br />
