III. Comments - Compliance <br /> Below are particular issues with regard to any of the compliance items. <br /> Enforcement actions resulting from failure to comply with the Act, Rules <br /> and Regulations, and the permit also are identified below. <br /> 4.04 Support Facilities <br /> Mid-Continent is proposing a revision to their permit to modify their <br /> clean coal blending facility. This will involve constructing an <br /> additional three storage bins in the area of previous disturbance. <br /> Conveyors will be added to aid in the mixing process and the installation <br /> will require the construction of a conveyor transfer point. The transfer <br /> point will impact an additional, undisturbed area of a minor nature. <br /> Based on observations of the proposed site, no particular problems would <br /> be anticipated for the proposal. <br /> 5.03 Enforcement <br /> Two items were specifically observed which are related to the OSM ten day <br /> notice number X-83-II-244-8-TV5. The culvert at the No. 1 mine was noted <br /> as being improperly designed. The culvert conveying disturbed runoff <br /> from the road was repaired by construction of a new headwall . <br /> The culvert conveying undisturbed drainage beneath the road was noted as <br /> being adequate. It was suggested that the culvert inlet should be <br /> extended. The Division is of the opinion that such a modification could <br /> be detrimental in that extending the culvert would, 1) increase the head <br /> requirement by increasing the length of the culvert and 2) potentially <br /> decrease the available head by eliminating the stilling basin. A <br /> response to this item has been submitted to OSM. <br /> R <br />
