This was again confirmed during the bond release <br />inspection. <br />Mr. Jim Woods and Mr. Ian Hause, representatives of Aspen Glen, accompanied the <br />inspection. Mr. Woods had telephoned the Division on November 2, <br />1993 with concerns <br />about some buried rubbish that had been uncovered by Aspen Glen during the excavation <br />activities. The rubbish allegedly included large chunks of concrete, steel rail, H beams, <br />structural iron, a septic tank, a buried metal building and toilet fixtures. <br />The Division reviewed the Permit Application Package and determined that the burial of the <br />non-hazardous rubbish had not violated any of the conditions of the permit. The situation <br />was discussed further between Mr. Woods, the Division, and Jim Stover of MINREC during <br />the bond release inspection. Mr. Woods was informed that the Division would not deny the <br />bond release on the basis of the buried rubbish, because the terms of the permit had not been <br />violated. He was further informed that any further negotiation regarding disposal costs for <br />the rubbish should be between Aspen Glen and MINREC and/or the previous landowner. Mr. <br />Stover also stated that he had previously disclosed information about the buried rubbish to <br />the attorney of the former landowner. <br />In a November 23, 1993 telephone call to Barbara Pavlik of the Division, Mr. Woods stated <br />that Aspen Glen does not object to the bond release at the Diamond A Parcel. <br />IV. PROPOSED DECISION <br />Because all criteria for a final bond release at the Diamond A Parcel have been met, the <br />Division proposes to approve the bond release request. The total bond amount held for the <br />entire Ioadout facility is $92,720.00. Of this amount,. $15,453.00 is required to revegetate <br />the slope within that portion of the Ioadout facility that is outside of the Diamond A Parcel. <br />Therefore, the Division proposes reducing the required bond amount for the Ioadout facility <br />from $92,720.00 to $15,453.00. <br /> <br />m:losslbjwlb1p.br2
