2) Additional info as committed to in the permit:
Pond F approved as permanent in 2007
In 2007, Minor gully repairs were conducted in the Marr Pit area, Pond D drainage, and the north
slope adjacent to Pond A. Curlex fabric was installed and interseeded with hand broadcast
permanent seed mix.
Willows were removed from the Load Out pond emergency spillway, and the Load Out access road
ditch was re-cut and cleaned in 2007.
KCC also provided the Annual Reclamation Report form for the year 2007. This form appears to be filled
out accurately to report cumulative disturbances, reclamation and bond releases. There is a
discrepancy between the DRMS database and KCC's values. The Division's database reports
disturbed acres for the Marr permit as 380.80, and affected acres as 380.80.
Looking back through the database record, SL I, approved January 23, 1996 reduced the disturbed and
affected acres to 378.0. During a portion of 1996 the acreage tracking feature was not recorded for
permitting actions. MR 34, approved November 1, 1999, increased the disturbed and affected area to
380.8 acres. The Division conducted a Midterm Review in 2003, which concurred with KCC's
disturbed and affected acreage values of 401.4 acres.
KCC considers the disturbed and affected acreage for the Marr Permit to total 401.4 acres. The DRMS
will bring these values into agreement during the SL4 decision process, which is expected to be
resolved summer 2008. KCC has re-digitized the disturbed, reclaimed, land in permanent features
(facilities, ponds, roads) and affected acreage using recent aerial photographs. KCC is committed to
disturbed and affected acreage total of 401.4 acres. This value is higher than the disturbed acreage
recorded by the Division. The Division is willing to accept KCC's disturbed acreage values. All
areas except 0.2 acres at the loadout (Loadout pond and ditch) have been reclaimed or have been
permitted to be retained as permanent features.
Please contact me if you have any questions regarding this review.
Sincerely
Jane inns
Protection Specialist II
(3
C:\jhb\C80006\ARR\2007 ARR review.doc
