2) Additional info as committed to in the permit: <br />Pond F approved as permanent in 2007 <br />In 2007, Minor gully repairs were conducted in the Marr Pit area, Pond D drainage, and the north <br />slope adjacent to Pond A. Curlex fabric was installed and interseeded with hand broadcast <br />permanent seed mix. <br />Willows were removed from the Load Out pond emergency spillway, and the Load Out access road <br />ditch was re-cut and cleaned in 2007. <br />KCC also provided the Annual Reclamation Report form for the year 2007. This form appears to be filled <br />out accurately to report cumulative disturbances, reclamation and bond releases. There is a <br />discrepancy between the DRMS database and KCC's values. The Division's database reports <br />disturbed acres for the Marr permit as 380.80, and affected acres as 380.80. <br />Looking back through the database record, SL I, approved January 23, 1996 reduced the disturbed and <br />affected acres to 378.0. During a portion of 1996 the acreage tracking feature was not recorded for <br />permitting actions. MR 34, approved November 1, 1999, increased the disturbed and affected area to <br />380.8 acres. The Division conducted a Midterm Review in 2003, which concurred with KCC's <br />disturbed and affected acreage values of 401.4 acres. <br />KCC considers the disturbed and affected acreage for the Marr Permit to total 401.4 acres. The DRMS <br />will bring these values into agreement during the SL4 decision process, which is expected to be <br />resolved summer 2008. KCC has re-digitized the disturbed, reclaimed, land in permanent features <br />(facilities, ponds, roads) and affected acreage using recent aerial photographs. KCC is committed to <br />disturbed and affected acreage total of 401.4 acres. This value is higher than the disturbed acreage <br />recorded by the Division. The Division is willing to accept KCC's disturbed acreage values.
