This is pursuant to CRS 34-32.5-109(T) <br />Type Ps <br />Topic OD <br />Corrective Action: <br />By September 1 st, 2008 please submit evidence to the office that this excavation if for the <br />construction of a building for the town of Bennett, Colorado, and that it is not a mining <br />operation as defined in C.R.S. 34-32.5-103(13) <br /> <br /> <br />4.) Problem/Possible Violation: <br />The bond at this time does not appear adequate to backfill the mine face to create a <br />3:1 slope required by the approved reclamation plan. This is a problem at this time for <br />failure to maintain the proper financial warranty amount to complete reclamation of the <br />affected lands pursuant to C.R.S. 34-32.5-117 (4) (b). November <br />4th, 2008 <br />Type Ps <br />Topic Fw <br />Corrective Action: <br />The office determined that the financial warranty should be increased to $10,430. The <br />Office will be sending a separate notice to Mr. Mitchell regarding the increase of the <br />financial warranty.
