Terror Creek road and the Hubbard Creek road. Also, please add a reference to the Cultural
Resources report as the description of prehistoric campsite 5DT1326
The Division has no further concerns. Pages 2.05-102, 103 and 104 were revised appropriately in
the December 28, 2006 submittal and submitted again in the June 25, 2008 submittal.
10. Portions of the Hubbard Creek road and the Terror Creek road are mentioned in Section
2.05.6(6)(a)(ii)(A) on revised page 2.05-103. However, only portions of the Hubbard Creek road
are described in Section 2.05.6(6) (b) (i) (C) on revised page 2.05-105. Please revise page 2.05-105
to include a description of the projected effects from subsidence on portions of the Terror Creek
road.
The Division has no further concerns. Page 2.05-106 was revised in the December 28, 2006
submittal to state that subsidence will not affect the Tenor Creek road since the road is outside the
projected angle of draw. This statement was moved to revised page 2.05-107 in the submittal dated
June 25, 2008.
11. In order to aid in the review process and under Rule 2.05.6(6)(a)(ii)(B), please add depictions to
Map 27 for those portions of the Hubbard Creek road and the Terror Creek road that are within
the permit and adjacent areas.
The Division has no further concerns. In the submittal dated December 28, 2006, Map 27 was
revised to include depictions of the Hubbard Creek road and the Terror Creek road.
12. On revised page 2.05-107, under Section 2.05.6(6)C1)(i), it is stated that Map 27 depicts the depth
of cover. The depth of cover numbers are present but the contours are barely visible. Please revise
Map 27 to show the depth of cover contours clearly.
The Division has no further concerns. Map 27 was revised in the December 28, 2006 submittal.
13. On revised page 2.05-107, there is an entry for Rule 2.05.6(6)(c)(i)(F). However, this rule applies
to the subsidence monitoring program, which is relevant only if there is a determination of no
material damage or diminution of reasonably foreseeable use. In order to avoid any confusion,
please omit this rule reference and move the information concerning the cessation of the
subsidence monitoring program to the text pertaining to Rule 2.05.6(6)(t7(v)(B) where the
subsidence monitoring program is described.
The Division has no further concerns. As explained in item number 4 above, a determination of no
material damage was initially made for the Bruce Park Dam and Terror Creek Reservoir. However,
the Division requested that BRL revise the permit text in Sections 2.05.6(6) and 2.04.7(3) to
include a worst possible consequence of material damage and diminution of reasonably
foreseeable use to the Terror Creek Reservoir, but not to the Bruce Park main and saddle dams,
due to mine induced seismicity possibly causing the Bruce Park landslide to negatively affect the
Terror Creek Reservoir. The revisions were made in a complete subsidence section submittal,
permit application pages 2.05-99 through 2.05-125, and page 2.04-37, in the submittal dated June
25, 2008.
