CC&V notes, though, that it is in compliance with the <br />discharge permit issued by the Water Quality Control Division for the Carlton <br />Tunnel and disagrees that the flow from the Carlton Tunnel is mine drainage. <br />Fay email of June 16, 2008 <br />Ms. Fay raises a number of matters many of which have been addressed in the <br />past but reiterated here. CC&V provides the following response to each of the <br />matters in Ms. Fay's email. <br />CC&V is uncertain of what is raised by "Is the current leach pad going to be the <br />location of the additional aggregate?" CC&V believes Ms. Fay is determining <br />the location of the additional valley leach facility ("VLF"). Under that <br />presumption, CC&V notes that proposed Phase 5 is addressed in Volume V, <br />Appendix 8 and as noted therein is to be constructed immediately east and north <br />connecting to the existing VLF. <br />The liner can support both the current weight and the proposed weight as <br />detailed in the MLE application in Volume VI, Appendix 8. <br />Monitoring of air quality is outside of the Mined Land Reclamation Act. <br />However, CC&V is in compliance with the air quality permit issued by the <br />Colorado Air Pollution Control Division. <br />Monitoring of surface and ground water as well as monitoring to confirm the zero <br />discharge status of the VLF is conducted by CC&V under its duly issued permits <br />and voluntary additional monitoring as reviewed and checked by various federal <br />and state agencies.
