Volume II, Appendix 1 of the MLE application provides exhaustive discussion on <br />surface and ground water hydrology and demonstrates that acid mine drainage <br />is not a matter of concern. <br />City of Cripple Creek ("Cripple Creek") letter of June 5, 2008 <br />Cripple Creek raises various matters, some of which are outside of the Mined <br />Land Reclamation Act. CC&V addresses below those matters that appear to be <br />within the jurisdiction of the Mined Land Reclamation Act. In addition, CC&V <br />was uncertain about the basis for various matters raised in Cripple Creek's letter <br />so sent a response to Cripple Creek on June 17, 2008. This letter is enclosed <br />so that DBMS has a complete file. Additionally, CC&V has met with Cripple <br />Creek representatives on numerous occasions to discuss further Cripple Creek's <br />letter and highlight that the submitted MLE permit application satisfies the <br />requirements of the Mined Land Reclamation Act. <br />CC&V references the above discussion on National Historic Landmark. <br />CC&V respectfully disagrees and asserts that its contemporaneous reclamation <br />activities have been quite successful, as discussed above. <br />CC&V conducts its operations in full compliance with noise requirements, as <br />addressed in Volume I, Attachment 8 of the MLE Mine Development Plan which <br />is part of the MLE application submittal. <br />CC&V addressed water supply and water quality in Volume VII, Appendix 9 and <br />Volume II, Appendix 2, respectively, of the MLE permit application. <br />CC&V has submitted a reclamation plan for MLE consistent with prior <br />reclamation plans submitted to and approved by the State of Colorado for the <br />Cresson Project (Amendment No. 6, Amendment No. 7, and Amendment No. 8). <br />That reclamation plan satisfies the requirements of the Mined Land Reclamation <br />Act. <br />Additional Comments <br />CC&V also is aware of two other comments submitted but not specifically <br />included in the packet sent by DRMS to CC&V via its letter of June 18, 2008. <br />CC&V addresses those two other comments below. <br />Park Center Water District ("Park Center") letter received July 9, 2008 <br />Park Center's letter was submitted after the close of the public comment period <br />and thus has no standing. Nevertheless, CC&V provides the following response <br />observing that Park Center's letter relates to water quality matters with reference <br />to the Carlton Tunnel. CC&V was uncertain about the basis for the letter so sent <br />a response to Park Center on July 18, 2008 for which Park Center provided a <br />reply on July 21, 2008.
